Led by director Tom Goode, the Research & Advice team offers specialist advice on all matters relevant to the statutory and regulatory environment, and development approvals, including court appeals if necessary. This team includes highly skilled professionals with qualifications and hands on experience in both the planning and legal fields, giving JBA the unique advantage of looking at projects from a broader perspective.

Being closely involved in the NSW planning system for the past 18 years, JBA is continually identifying ways to provide services of real value to our clients in the public and private sectors, particularly at the front-end of the development process. Our aim is to find planning and development solutions acceptable to all parties, help negotiate sensible outcomes and if necessary mediate, or otherwise facilitate the process.

The Research & Advice team works directly with our clients and their advisors, bringing new perspectives to statutory and planning merit issues.

  • High level statutory planning and appeals advice on development opportunities, regulatory requirements, the approval process, development compliance and identification of development approval pathways

Due Diligence

JBA understands the importance and value of town planning due diligence as a crucial input to decision making and risk assessment when it comes to property valuation, acquisition or development. Due diligence advice can help identify, avoid or minimise the planning risks, and help maximise a project’s development potential. JBA’s due diligence advice can assist and add value to land owners or purchasers, financiers, administrators, valuers and real estate agents.

In undertaking a planning due diligence we provide valuable advice on:

  • statutory planning instruments and controls
  • site attributes and risks
  • development potential and basic yield analysis
  • planning merit assessment
  • planning approval strategies and pathways

One example of a due diligence investigation involved a controversial development site in coastal NSW. In the end our client decided to not purchase the property having become fully informed of the myriad of complex planning issues and the considerable risks associated with developing the land.

Development Assessment Auditing

Approval authorities such as Councils have an increasing focus on transparency and accountability in decision making. Development assessment auditing involves the review of decisions and procedures by an independent auditor to determine consistency with the planning framework and regulation, as well as State and Council planning policies and procedures. JBA has reviewed planning decisions on behalf of a number of consent authorities and has prepared reports and recommendations to improve their internal development assessment processes.
